Dr. Cheryl van der Mark, developer of Skillful Birthing, has been teaching skills-based physiological labor and delivery techniques to pregnant women and their partners for over 22 years. She is an award-winning, internationally trained perinatal and pediatric chiropractor, and has been blessed to attend many amazing births both at home and in hospitals. Dr. Cheryl has helped thousands of women have better birth experiences and is a dedicated birth coach.

Skillful Birthing is a registered business under the legal corporation ChiroLink Coaching Inc.

Scope of the Course

This course provides educational content intended to equip participants with mental and physical techniques to support a positive birthing experience. These techniques include, but are not limited to, hands on pelvic rocking skills, body awareness skills, coping and meditation skills, labour and birth positions and relaxation methods. This course does not offer medical advice, diagnosis, or treatment and does not replace the care provided by qualified healthcare professionals, such as general practitioners, obstetricians, midwives, chiropractors or pelvic floor therapists.

Throughout this course, if there is reference to the birth partner using ‘he/him’, please understand that this is intended to be inclusive of all genders, including those who use ‘she/her’ pronouns. The goal is to make this course accessible and relevant to all birth partners.

Assumption of Risk

By participating in this course, I acknowledge that I am voluntarily engaging in techniques and activities that may involve physical movement, personal effort and hands on partner applied pressure to the pelvis and surrounding structures. I understand and assume all risks associated with these activities, including but not limited to physical discomfort or unintended outcomes, such as but not limited to, pain, premature labor, bleeding, loss of pregnancy, and death. I agree to consult my healthcare provider and obtain medical clearance prior to using any techniques discussed in this course. Participants should stop activities if they experience adverse symptoms and consult their healthcare provider immediately. The Skillful Birthing course is intended for educational purposes only and is not a substitute for medical advice, diagnosis or treatment. No doctor/patient relationship is formed during this course. Advise is received and implemented at the users own risk and participation in voluntary.

Release of Liability

Participants agree to:  

-Waive, release, and discharge Dr. Cheryl van der Mark, Skillful Birthing, ChiroLink Coaching Inc., Skillful Birthing and ChiroLink Coaching Inc. employees, and any and all affiliates from any claims or liabilities related to their participation in the course. 

- Indemnify Dr. Cheryl van der Mark, Skillful Birthing, ChiroLink Coaching Inc., Skillful Birthing and ChiroLink Coaching Inc. employees, and any and all affiliates against any claims brought by third parties arising from their participation.

Intellectual Property

All Skillful Birthing course materials, recordings, and resources are intellectual property of Skillful Birthing and Dr. Cheryl van der Mark. Sharing, distributing, or reproducing the materials without explicit permission is strictly prohibited. 

No Guarantees

The Skillful Birthing course does not guarantee specific outcomes, including a complication-free, vaginal or pain-free birth.  

Refund Policy

We offer a 14-day refund policy for our Skillful Birthing course. If for any reason you are not satisfied with the Skillful Birthing course, you may receive a full refund no later than 14 days from date of purchase. To initiate your refund, please contact [email protected] with your information included. You may be asked a series of questions to gather feedback. 

Refunds may take up to 2-3 business days to be processed, and can take up to 5 business days to show on your bank statement.

Program Length & Fees

The Skillful Birthing program is 4 weeks long with new modules released weekly. You will have access to Skillful Birthing course materials for 6 months, starting from your purchase date.

Fees for the full program are due in full at the time of purchase. Users will have access to our private online Facebook community and live Q&A sessions for 6 months.

Payment can be made via credit card only. We accept Visa and M/C.

Force Majeure

Skillful Birthing and ChiroLink Coaching Inc. shall not be held liable for any failure or delay in performing its obligations under these Terms of Service if such failure or delay is due to causes beyond its reasonable control, including but not limited to acts of God, natural disasters, government restrictions, wars, insurrections, labor strikes, technical failures, cyberattacks, pandemics, interruptions in telecommunications, internet service, or power supply, or any other cause beyond its reasonable control. In the event of such a delay or failure, Skillful Birthing will make reasonable efforts to resume services as soon as feasible. However, no refunds or compensation will be provided for interruptions caused by force majeure events.

Privacy and Confidentiality Policy: The privacy section aligns with the Personal Information Protection and Electronic Documents Act (PIPEDA) requirements in Canada

At ChiroLink Coaching Inc. and/or Skillful Birthing("we," "our," or "us"), we are committed to protecting your privacy. This Privacy Policy outlines the types of personal information we collect, how we use it, and how we protect it. By using our video-sharing services, you agree to the collection and use of information as described in this policy

1. Information We Collect

We may collect the following types of personal information:

-Personal Information: This includes details such as your name, email address, and contact information when you create an account with us.

-Health Information: For personalization of educational materials and conversations, you may voluntarily provide details about your health, pregnancy, and any medical conditions.

-Payment Information: When you purchase a subscription or any other program or course service, we may collect payment information, such as your billing address and payment details, through a third-party payment processor.

-Usage Data: We may collect data on how you interact with our exercise videos, website, or app, including what content you view, which videos you watch, and your preferences.

-Recorded Live Video: Live Q&A sessions with our team members may be recorded for quality assurance, program improvements and educational purposes, with participants’ consent.

-Voluntary Video Submissions: Users may voluntarily submit a video to us for the purposes of our review, feedback and discussion with the user. Such videos will be collected and kept on a secure platform that follows PIPEDA compliance only until review and feedback, after which time they will be deleted from the platform. Video submissions will not be stored for further use, or shared with others by us, without the expressed written consent of the user.  

2. How We Use Your Information

We use your information for the following purposes:

-To Provide Services: To deliver prenatal videos, programs, feedback and content that best suit your needs.

-To Process Payments: To facilitate payments for subscriptions or other purchases.

-To Improve Services: To understand user preferences and improve the content, functionality, and user experience of our platform.

-To Communicate with You: To send updates, reminders, or notices regarding your account, subscriptions, or new content.

-Legal Compliance: To comply with legal obligations and resolve disputes.

3. How We Protect Your Information

We use reasonable security measures to protect your personal information from unauthorized access, use, or disclosure. These measures include encryption, secure storage, and restricted access. However, no data transmission method is 100% secure, and we cannot guarantee the absolute security of your data.

-Third-Party Service Providers: We may share your information with service providers who assist us in providing the platform (e.g., payment processors, website hosting services, etc.), but only to the extent necessary to perform their functions.

 If you choose to join or interact with our social media communities, we are not liable for data breaches or misuse by these third parties such as Facebook, TikTok, Instagram, WhatsApp or other third party user accounts.

We reserve the right to update this Privacy Policy from time to time. Any changes will be reflected on this page, and the "Effective Date" will be updated. We encourage you to review the policy periodically.

This waiver is governed by the laws of Ontario, Canada, and any disputes will be resolved within this jurisdiction. If any part of the agreement is found unenforceable, the remainder still applies.
